1. About AgentFlow

AgentFlow is a SaaS (Software as a Service) platform operated by Sudip Dolai that provides AI-powered tools for real estate agents, including automated lead follow-up, WhatsApp messaging, AI listing generation, appointment booking, and reporting. Our platform is designed for professional real estate agents primarily operating in the UAE and UK markets.

2. Eligibility

To use AgentFlow you must:

• Be at least 18 years of age
• Be a professional real estate agent or work in the property industry
• Provide accurate and complete registration information
• Have the legal authority to agree to these terms on behalf of yourself or your business

3. Account Registration

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Keep your password secure and confidential
• Notify us immediately of any unauthorised access to your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these terms or are found to contain false information.

4. Subscription & Payment

AgentFlow operates on a subscription basis:

• A free trial is available for 14 days with no credit card required
• After the trial, a paid subscription is required to continue using the platform
• Subscription fees are billed monthly or annually as selected
• All fees are non-refundable unless required by applicable law
• We reserve the right to change pricing with 30 days' notice
• Failure to pay will result in suspension of your account

5. Acceptable Use

You agree to use AgentFlow only for lawful purposes. You must NOT:

• Send spam, unsolicited messages, or harassing communications to leads
• Use the platform to send messages to contacts who have not expressed interest in your property services
• Violate WhatsApp's Business Policy or Meta's Platform Terms
• Upload false, misleading, or fraudulent property listings
• Attempt to reverse engineer, copy, or replicate the AgentFlow platform
• Use the platform in any way that could damage our reputation or systems
• Share your account credentials with others

6. WhatsApp & Meta Platform Usage

When using AgentFlow's WhatsApp features, you agree to:

• Comply with Meta's WhatsApp Business Policy at all times
• Only message leads who have genuinely contacted you about property
• Not use the automated messaging feature for spam or unsolicited promotions
• Take full responsibility for the content sent through your connected WhatsApp number
• Ensure your WhatsApp Business number is legitimately registered to you

Violation of WhatsApp's policies may result in your number being banned by Meta. AgentFlow is not responsible for such bans.

7. AI-Generated Content

AgentFlow uses AI (including OpenAi) to generate property listings, follow-up messages, and reports. You acknowledge that:

• AI-generated content may contain errors or inaccuracies
• You are responsible for reviewing and verifying all AI-generated content before use
• You own the rights to content generated using your inputs on our platform
• AgentFlow is not liable for any losses arising from reliance on AI-generated content

8. Intellectual Property

AgentFlow and all its content, features, and functionality are owned by Sudip Dolai and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our platform without explicit written permission.

9. Data & Privacy

Your use of AgentFlow is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using AgentFlow, you consent to our data practices as described in the Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, AgentFlow and Sudip Dolai shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of leads, revenue, or business opportunities
• Interruptions to the service due to technical issues or maintenance
• Actions taken by Meta/WhatsApp including number bans or API changes
• Errors in AI-generated content used in your business

Our total liability to you shall not exceed the amount you paid us in the 3 months prior to the claim.

11. Service Availability

We aim to provide a reliable service but do not guarantee 100% uptime. We may occasionally suspend access for maintenance or updates. We will provide advance notice where possible.

12. Termination

You may cancel your account at any time from your dashboard settings. We may terminate or suspend your account immediately if you violate these Terms. Upon termination, your access to the platform will cease and your data will be deleted within 30 days as per our Privacy Policy.

13. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you by email of significant changes. Continued use of AgentFlow after changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of India. For UK-based users, relevant UK consumer protection laws also apply. Any disputes will first be attempted to be resolved amicably by contacting us directly.
